TERMS AND CONDITIONS
I. GENERAL PROVISIONS

The operator of the e-shop is Everlastcut s.r.o., with its registered office at Prague, Company ID: 21018979, registered in the Commercial Register maintained by Prague, e-mail: leomacenauer@gmail.com.

These Terms and Conditions govern the mutual rights and obligations between the Seller and the Buyer when purchasing goods through the e-shop.

The Buyer is either a consumer or a business entity who enters into a purchase contract with the Seller.
II. PRODUCTS AND ORDERS

Custom-Made Production: All products offered in the e-shop are manufactured exclusively based on the Buyer's binding order. Products are not kept in stock, and production starts only after the order is accepted and full payment is received. Even when selecting from available size options (S, M, L, XL, etc.) or colors, the product is made specifically for the Buyer according to their choice and does not exist as a pre-made item.

Product descriptions, including material composition, features, and prices, are listed individually for each product in the e-shop. Prices are final and include VAT.

The purchase contract is concluded once the Seller confirms the Buyer’s order. Submitting the order constitutes an offer by the Buyer to conclude the contract.

The Seller reserves the right to reject an order if the product cannot be manufactured due to technical, capacity, or other objective reasons.
III. PAYMENT AND DELIVERY TERMS

Goods can be paid for in advance by bank transfer or online by credit card.

Production of the goods will commence only after payment is received.

Production and delivery time is 14 to 30 calendar days from the date of payment, depending on the product type and complexity. In justified cases, the Seller reserves the right to extend this period, with prior notice to the Buyer.

Goods are delivered by DPD courier service to the address specified by the Buyer in the order.

Delivery costs are governed by the current price list specified in the order form and are borne by the Buyer.
IV. WITHDRAWAL FROM THE CONTRACT

All goods are custom-made according to the Buyer’s individual selection and are not kept in stock.

In accordance with Section 1837(d) of the Czech Civil Code, the Buyer is not entitled to withdraw from the contract, as the goods are made to the Buyer’s specifications or clearly personalized.

The Buyer is informed of the impossibility of withdrawal before placing the order and explicitly confirms this when concluding the purchase contract.

The Buyer may only withdraw from the contract if the goods are defective. In such a case, the Complaints Procedure applies.
V. COMPLAINTS PROCEDURE

The Seller is liable for defects present at the time of delivery and for defects that appear within 24 months of the Buyer’s receipt of the goods.

The Buyer must file a complaint without undue delay after discovering the defect.

Complaints can be submitted by e-mail to [email], in writing to the Seller's registered office, or by phone.

The Buyer must provide proof of purchase or otherwise demonstrate that the goods were purchased from the Seller.

Defects do not include normal wear and tear, changes caused by washing or maintenance, color deviations within production tolerances, or variations resulting from the Buyer’s specific customization.

If the complaint is justified, the Buyer is entitled to a free repair, a reasonable price reduction, a replacement, or withdrawal from the contract.

Complaints will be processed within 30 days of being filed, unless the parties agree otherwise.

If the complaint is found to be unjustified, the Buyer bears the costs of transportation and any additional expenses.
VI. PERSONAL DATA PROTECTION

The Seller processes the Buyer’s personal data in accordance with applicable legislation, including the GDPR Regulation and the Czech Personal Data Protection Act.

The purpose of processing personal data is to fulfill the contract, deliver goods, comply with legal obligations (e.g., accounting), and direct marketing.

Personal data is only accessible to necessary processors (e.g., couriers) and retained only for as long as necessary for the purposes of processing.

The Buyer has the right to access their personal data, request correction, erasure, restriction of processing, data portability, and the right to object to processing.

VII. OUT-OF-COURT DISPUTE RESOLUTION

In case of a consumer dispute between the Seller and the Buyer, the Buyer has the right to an out-of-court resolution through the Czech Trade Inspection Authority (ČOI), Štěpánská 15, 120 00 Prague 2, www.coi.cz.
VIII. FINAL PROVISIONS

These Terms and Conditions are valid and effective as of [date] and available on the e-shop’s website.

All legal relationships arising between the Seller and the Buyer are governed by the laws of the Czech Republic.

The purchase contract is concluded in the Czech language and is archived by the Seller in electronic form.

The Buyer confirms that they have read and fully agree to these Terms and Conditions.
IX. DISTINCTION BETWEEN CONSUMER AND BUSINESS BUYERS

If the Buyer provides their Company ID (IČO) when placing the order, they acknowledge that the provisions of these Terms and Conditions and legal rights relating to consumer protection, particularly the right of withdrawal under Section 1829 et seq. of the Czech Civil Code, do not apply to them.

Business Buyers are not entitled to out-of-court dispute resolution through the Czech Trade Inspection Authority or other consumer protection mechanisms reserved for consumers.
X. CHANGES TO TERMS AND CONDITIONS

The Seller reserves the right to unilaterally change or amend these Terms and Conditions. The updated version will be published on the e-shop website and becomes effective upon publication, unless otherwise stated.

Rights and obligations established before the effective date of the updated Terms and Conditions remain unaffected.
XI. SHIPPING AND RECEIPT OF GOODS

Goods are delivered by DPD courier service to the address specified by the Buyer in the order.

The Buyer is obliged to inspect the shipment upon receipt, especially the integrity of the packaging and the number of parcels. If any visible damage or discrepancy is found, the Buyer must record the issue with the courier in a damage report and inform the Seller without undue delay.

By signing the delivery document, the Buyer confirms that the shipment was received in good condition, and no claims regarding visible packaging damage will be accepted later.

In case of hidden defects caused during transport, the Buyer must report such issues to the Seller no later than 24 hours after receiving the shipment.
